갑은 202 1년 6월 2 0일 자기 소유인 X부동산을 을에게 매도하고, 을로부터 계약금과 중도 금을 수령하였다. 그 후 병의 대리인 무는 갑과 을 사이의 위 매매계약 체결사실을 알 면서도. X부동산의 매도를 주저하는 갑에게 적극적으로 더 높은 가격의 지급을 약속 하여 갑과 X부동산의 매매계약을 체결하였다. 병은 2021. 10. 10. 갑으로부터 소유권 이전등기를 마쳤다. 병은 갑과 을 간의 위 계약체결 사실을 알지 못했다. 이 경우 을이 자신의 권리를 구제받기 위해서는 누구를 상대로 어떤 청구를 하여야 하는지 근거를 제시해서 설명하시오. 미성년자인 갑은 법정대리인의 동의를 받지 않고 신용카드업자인 을과 신용카드이용계약을 체결하였다 . 갑은 위 계약에 기해서 받은 신용카드를 이용하여 병 가맹점으로부터 상품을 구매하였고 을은 병 가맹점에 대하여 그 신용카드사용대금을 지급하였다. 이 후 미성년자 갑은 을과 맺은 위 신용카드 이용계약을 취소하였다. 갑이 을에게 반환 하여야 할 부당이득은 무엇인지 그 논거와 함께 서술하시오.
